Terms of Use

These Terms of Use (“Terms”) govern access to and use of Iftale (“Platform”), a service for creating, publishing, and reading interactive stories. By creating an account or using the Platform, you declare that you have read, understood, and fully accepted these Terms and our Privacy Policy. If you do not agree, do not use the Platform. This is a courtesy translation; in case of conflict, the Portuguese version prevails.

1. Definitions

For the purposes of these Terms, the following definitions apply:

  • “Platform”: Iftale's service, website, applications, and tools.
  • “User”: any person who accesses or uses the Platform.
  • “Author”: the User who creates, edits, or publishes stories, texts, images, audio, or other materials on the Platform.
  • “Reader”: the User who accesses and plays published stories.
  • “Author Content”: all material submitted, created, or published by an Author, including text, images, illustrations, tracks, sound effects, characters, trademarks, and any other assets.
  • “Platform Content”: the software, interface, visual identity, trademarks, and materials owned by Iftale.

2. Eligibility and minimum age

The Platform is intended exclusively for people over 18 (eighteen) years of age. By using the Platform, you represent and warrant that you are at least 18 years old and have full legal capacity to accept these Terms.

Registration or use by minors under 18 is prohibited. If we identify an account belonging to a minor, we may suspend or terminate it summarily, without prejudice to other applicable measures.

3. Registration and account

To access certain features, you must create an account with true, accurate, and up-to-date information. You are solely responsible for keeping your credentials confidential and for all activity performed on your account.

You must notify us immediately of any unauthorized use of your account. We may refuse, suspend, or cancel registrations at our discretion, especially in case of violation of these Terms.

4. Author Content: ownership and exclusive responsibility

The Author is solely and exclusively responsible for all Author Content they create, submit, or publish, including text, images, illustrations, audio, tracks, sound effects, characters, names, trademarks, and any other assets.

By publishing Author Content, you represent and warrant that:

  • you own all rights to the content, or hold all licenses, authorizations, and assignments necessary to publish and license it under this clause;
  • the content does not violate copyrights, trademarks, image rights, personality rights, privacy, trade secrets, or any other third-party rights;
  • the content is not unlawful, defamatory, discriminatory, or an incitement to violence or hatred, and does not infringe any applicable law.

The Platform does not pre-review or verify the ownership, originality, or lawfulness of Author Content. Responsibility for any infringements — including content protected by third-party copyright — rests exclusively with the Author.

5. Platform disclaimer

The Platform acts as an internet application provider and mere host of Author Content. We are not authors, co-authors, co-publishers, or responsible for Author Content, nor do we endorse opinions, statements, or materials contained in it.

Under the Brazilian Internet Civil Framework (Law No. 12,965/2014), the Platform is not civilly liable for damages arising from Author Content generated by third parties, and may only be held liable if, after a specific court order, it fails to make the content identified as infringing unavailable, except for the legal cases of removal upon notice.

Any claim, dispute, or loss related to Author Content — including violation of copyright, trademark, image, or any other right — must be directed to the respective Author, who assumes full and exclusive responsibility.

6. License granted to the Platform

You retain ownership of your Author Content. By publishing it, however, you grant the Platform a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, technically adapt (for example, resizing or converting formats), display, communicate to the public, distribute, and make available the Author Content, for the purpose of operating, promoting, and improving the Platform.

This license includes the Platform's right to promote and advertise Author Content — in showcases, collections, editorial selections, social media, marketing campaigns, and promotional materials — including in association with the Author's public name, pseudonym (“handle”), and profile.

The license remains valid while the content is published. Upon removal or account termination, the license ceases for new uses, except for copies in backups for a reasonable period and promotional materials already released.

7. Age rating and adult content

The Author is responsible for correctly rating their Author Content regarding age range and the nature of the material, clearly and prominently flagging any content unsuitable for minors, sensitive, or adult (“18+”), such as intense violence, sexual content, inappropriate language, or sensitive themes.

The absence, inaccuracy, or omission of the age rating is the Author's sole responsibility. The Platform may, at its discretion, re-rate, restrict display, hide behind an age warning, or remove content it deems improperly rated.

Considering that the Platform is intended for adults over 18, adult content flagging serves informational and internal access-control purposes, and does not exempt the Author from their legal obligations.

8. Prohibited conduct and content

It is forbidden to use the Platform to create, publish, or distribute content that:

  • violates copyrights, trademarks, or any third-party rights;
  • is unlawful, fraudulent, defamatory, discriminatory, or incites hatred, violence, or discrimination;
  • involves exploitation or abuse of children and adolescents, or any child sexual abuse material;
  • contains malware or spam, or attempts to circumvent security, moderation, or age-control mechanisms;
  • impersonates another person or misleads third parties about the authorship or origin of the content.

It is also prohibited to use the Platform to collect third-party data without authorization or for any purpose that violates applicable law.

9. Moderation, removal, and summary deletion

The Platform reserves the right, at any time and at its sole discretion, to moderate, restrict, hide, unpublish, or remove, summarily and without prior notice, any Author Content that violates these Terms, applicable law, or third-party rights, as well as to suspend or terminate the responsible Author's account.

Summary removal may occur, among other cases, upon a substantiated copyright infringement report, third-party notice, order from a competent authority, or risk to the security of the Platform and other Users.

Content removal or account termination due to a violation does not entitle the User to indemnification, refund, or compensation.

10. Copyright infringement reports

If you believe content published on the Platform violates your copyright or other rights, contact us at contato@iftale.com, providing: the identification of the content and its location (link); a description of the right violated; your contact details; and a good-faith statement that you are the rights holder or an authorized representative.

We will review reports and may remove or restrict the identified content, notify the Author, and, in case of repeat offenses, terminate the infringing account.

11. Platform intellectual property

The software, interface, design, trademarks, logos, and other elements of the Platform Content are owned by Iftale or its licensors and protected by applicable law. These Terms do not transfer to you any rights over the Platform Content, except for the limited license to use it for the purposes set out here.

12. Disclaimer of warranties

The Platform is provided “as is” and “as available”. We do not guarantee that the service will be uninterrupted, error-free, secure, or that it will meet specific expectations. To the fullest extent permitted by law, we disclaim implied warranties of fitness for a particular purpose.

13. Limitation of liability

To the fullest extent permitted by applicable law, the Platform shall not be liable for indirect damages, lost profits, data loss, or damages arising from: (i) Author Content or third-party content; (ii) use of or inability to use the service; (iii) unauthorized access to data; or (iv) third-party conduct on the Platform.

14. Indemnification

The Author agrees to defend, indemnify, and hold the Platform, its affiliates, and collaborators harmless from any claims, losses, damages, liabilities, and expenses (including attorney's fees) arising from or related to their Author Content, violation of these Terms, or violation of third-party rights.

15. Suspension and termination

You may close your account at any time. We may suspend or terminate your access, with or without notice, in case of violation of these Terms, legal requirement, or risk to the Platform and third parties.

Termination does not affect obligations and responsibilities assumed up to that point, nor the licenses and provisions that, by their nature, should survive.

16. Privacy and data protection

The processing of personal data on the Platform is governed by our Privacy Policy, in accordance with the Brazilian General Data Protection Law (Law No. 13,709/2018 — LGPD). Upon accepting these Terms, we recommend reading the Privacy Policy carefully.

17. Changes to these Terms

We may change these Terms at any time. Relevant changes will be communicated by reasonable means (for example, a notice on the Platform or by email). Continued use after the changes take effect implies acceptance of the updated version. The date of the last update appears at the top of this document.

18. Governing law and venue

These Terms are governed by the laws of the Federative Republic of Brazil. The courts of the User's domicile, when acting as a consumer, are elected to settle disputes arising from these Terms, subject to specific legal jurisdictions.
